Description

This panel will provide an overview of potential disciplinary issues arising from the use of social media by public employees, from the perspectives of two employer representatives, two union representatives, and a labor arbitrator. The discussion will focus on “just cause” concerns (e.g., reasonableness of the employer's policy, off duty misconduct/nexus to employment, and disparagement of the employer); employees’ First Amendment rights; and protections for employees under the IPLRA, the IELRA, and other statutes. The discussion will include a review of various case scenarios, and the panelists’ best practice recommendations.

James Q. Brennwald Related seminars and products

James Q. Brennwald is a full-time labor arbitrator and mediator in Chicago, currently serving on several panels for local public employers and public employee unions. After graduating from the University of Michigan and Loyola University School of Law, he spent the first six years of his legal career with Edes and Rosen, where he represented SEIU Local 1 in NLRB matters and collective bargaining negotiations. He then went to work for the City of Chicago’s Department of Law as an Assistant Corporation Counsel in the Law Department’s Labor Division, before becoming the City’s Assistant Chief Labor Counsel, and then Chief Labor Negotiator. He left the City in late 2011 to accept an appointment to the State Panel of the Illinois Labor Relations Board, where he served for a little over three years before embarking on his career as a labor arbitrator.

Anita Tanay is General Counsel for Amalgamated Transit Union Local 308, the union representing the Chicago Transit Authority rail system workers. Previously, Ms. Tanay was a partner at Jacobs, Burns, Orlove and Hernandez in Chicago. Throughout her career, she has represented labor unions and has handled countless arbitration cases dealing with all facets of contract interpretation and discipline issues. Ms. Tanay received her B.A. and J.D. from the University of Michigan.
