This panel will provide an overview of potential disciplinary issues arising from the use of social media by public employees, from the perspectives of two employer representatives, two union representatives, and a labor arbitrator. The discussion will focus on “just cause” concerns (e.g., reasonableness of the employer's policy, off duty misconduct/nexus to employment, and disparagement of the employer); employees’ First Amendment rights; and protections for employees under the IPLRA, the IELRA, and other statutes. The discussion will include a review of various case scenarios, and the panelists’ best practice recommendations.

Previously, Ms. Tanay was a partner at Jacobs, Burns, Orlove and Hernandez in Chicago. Throughout her career, she has represented labor unions and has handled countless arbitration cases dealing with all facets of contract interpretation and discipline issues.
