Description

The panelists will discuss what if any impact Illinois’ recreational marijuana law has had on public employers with “safety-sensitive employees,” grounds and methods for marijuana testing in the workplace, the increasing popularity of medical marijuana and CBD products and how that increase will implicate existing drug testing policies. They will also provide an update on relevant arbitration awards concerning marijuana and the public workplace.

Bryan Diemer is an attorney with the International Union of Operating Engineers, Local 150, AFL-CIO.  Bryan received a law degree with honors from Chicago-Kent College of Law, as well as a master’s degree in labor and industrial relations and a bachelor’s degree in economics-- both from the University of Illinois at Urbana-Champaign.  Throughout his career, he has represented labor unions and related Taft-Hartley benefit funds in federal and state court, as well as administrative agencies such as the National Labor Relations Board and the Illinois Labor Relations Board.  Bryan has also negotiated many public and private sector collective bargaining agreements and arbitrated many grievances arising under those collective bargaining agreements.

Chicago Transit Authority


Brad Jansen is Deputy General Counsel, Labor & Employment for the Chicago Transit Authority, where he has worked since 1996. Mr. Jansen manages labor relations with 17 unions representing 10,000 employees. He represents the CTA in negotiations, interest arbitrations, and grievance arbitrations. He advises executive management on labor and employment matters, including wage and hour issues, FMLA and ADA compliance, and EEO policies. Mr. Jansen frequently develops and conducts management training programs. He and his section attorneys also represent the CTA in state and federal courts, the EEOC, the Illinois Human Rights Commission and other agencies. Mr. Jansen is an adjunct professor at Roosevelt University, where he teaches labor and employment law. He received his B.A. in English from the University of Illinois at Chicago and his J.D. from IIT Chicago-Kent College of Law.

Peter Conrad McNamara serves as Staff Attorney for the International Union of Operating Engineers, Local 399. He is its lead trial counsel and is adept in all phases of litigation: from pre-discovery motion practice to post-trial practice. He is a member of the trial bar of the Northern District of Illinois and is licensed to practice before the Seventh Circuit.

Mr. McNamara's experience spans both sides of the employment relationship. Prior to his current role, Mr. McNamara served as Chief Attorney, Labor & Employment for Chicago Transit Authority for five years and managed labor & employment matters for the Federal Aviation Administration for eight years. His legal journey began in 2007, with the International Union of Operating Engineers, Local 150, championing employees and union rights. Beyond his advocacy, McNamara serves as an arbitrator for the Circuit Court of Cook County’s Mandatory Arbitration program.

Mr. McNamara is active in his adopted hometown of Park Ridge. He was the recipient of the 2019 Park Ridge Beautification Award, served as Chair of the Park Ridge Board of Fire & Police Commissioners, and has coached five-, six-, and seven-year-olds in Park Ridge Baseball. A first-generation American, with roots in Peru and Ireland, family comes first. His proudest titles are “father” to River (1), Isla (5), and Jack (8) and “husband” to Eva who lovingly, and not begrudgingly, supports his dream of one day breaking 80 in golf.


Mr. McNamara obtained his J.D. from Southern Illinois University School of Law, where he served as the Associate Editor of the Journal of Legal Medicine and his B.A. from DePaul University.

Robert J. Scherschligt is Legal Counsel for the International Brotherhood of Teamsters Local Union No. 916 in Springfield, Illinois. His current practice consists of negotiating collective bargaining agreements, and representing the Union in disciplinary matters, grievances, mediations, and arbitrations. Prior to joining the Teamsters, Bob served as Sangamon County’s Chief Public Defender from November 2010 until January 2020. He has more than 27 years of litigation experience at the county, state, and federal levels. Bob received his Bachelor of Science degree in accounting from Millikin University and his Juris Doctorate degree from Creighton University’s School of Law. He is a registered certified public accountant and is licensed to practice law in the states of Illinois and Missouri. In addition, he is admitted to practice law before the United States District Court for the Central District of Illinois and the Seventh Circuit United States Court of Appeals.
