The Evolving Status of 8(a)(3) Discrimination Cases


In recent years, the Board has changed and refined how it analyzes cases alleging that an employer has unlawfully disciplined or discharged employees because of their union activities. This presentation will address how the Board has altered how it views the burdens of proof under the Wright Line standard, and overruled prior precedent in cases where an employee has committed misconduct while engaging in union or protected concerted activities.
