First Wednesday Series: The Legal Authority of the Illinois National Guard

The first nine months of 2020 have been particularly busy for the National Guard throughout the country.  So far, states and their respective National Guard units have had to deal with six of the all-hazards that they train and prepare for as a part of their state missions.  In 2020 so far, the Illinois National Guard has performed various duties to include: cyber-election assistance to the State Board of Elections, COVID-19 Pandemic, Flood Duty, and Domestic Disturbance Duty simultaneously.  Other states such as California, Oregon and Washington have also dealt with Forests Fires and earthquakes and states like Florida, Louisiana, Mississippi have had to deal with several hurricanes. 

There are various legal authorities that authorize the National Guard to respond to natural disasters and hazards.  During this presentation, Col Martin Green, Judge Advocate for the Illinois National Guard Joint Force Headquarters will cover the various state and federal legal authority for use of the National Guard and the various duty statuses that accompany the legal authority.  Col Green will also cover aspects of the National Guard’s Domestic Operations and the framework and analysis for missions.  

This program will provide an understanding of the technical and legal issues of today. 

 

Colonel John "Marty" Green, State Staff Judge Advocate - Air, Illinois National Guard

Col. John M. Green is the State Staff Judge Advocate for the Joint Force Headquarters of the Illinois Air National Guard, Springfield, Ill. He serves as a principal legal advisor to the Adjutant General and the Commander of the ILANG. He also coordinates the provision of legal services to the state’s three Air Wings and tenant units. 

 

Col. Green received a direct commission as an Air Force judge advocate in April 1998. Prior to being assigned to JFHQ, he served as the Staff Judge Advocate of the 183d Wing.  Col. Green has also served as judge advocate to the Commander of Task Force Pelican during Hurricane Katrina and as senior Title 32 legal advisor to the Dual Status Commander for NATO Summit in Chicago.  He is admitted to practice law before the Supreme Court of Illinois, the United States Court of Appeals for the Seventh Circuit, the United States District Court for the Central District of Illinois, the Court of Appeals for the Armed Forces, and the Air Force Court of Criminal Appeals.

 

In his civilian capacity, Col. Green serves as the Vice President of Government Relations and Regulatory Affairs for the Illinois CPA Society.  He is also an Adjunct Faculty Member at Western Illinois University where he teaches Legal Issues and Emergency Management and lectures on the Illinois Emergency Management Act. Col. Green is a member of the Illinois State Bar Association’s Military Law Committee, the Illinois Attorney General’s Charitable Advisory Committee and the Board of Directors at Sacred Heart Griffin High School and the Memorial Hospital Foundation.  He is an Eagle Scout and is a Council Member At-Large of the Abraham Lincoln Council Boy Scouts of America.  A past President of the Western Illinois Alumni Association, Col. Green is a recipient of the Alumni Achievement Award.
